§ 1 Scope

These Terms and Conditions apply to the use of the iOS app "SkyDrop" (hereinafter "App") and this informational website. By downloading, installing or using the App, you accept these Terms and Conditions.

§ 2 Service Description

SkyDrop is a physics-based puzzle and skill game for iOS. The App includes, among other things:

  • Challenge mode with hand-crafted levels
  • Endless mode with procedurally generated levels
  • Various obstacles and clouds with different physics properties
  • Unlockable markers, hats and crystals
  • Statistics about your gameplay results
  • Optional advertising and a one-time in-app purchase to remove banner ads

§ 3 Use Without User Account

  1. The App can be used without registration or a user account.
  2. Game progress and settings are stored locally on your device.
  3. You are responsible for protecting your device and performing regular backups via iOS features if you wish to preserve your progress.

§ 4 Terms of Use

  1. Use of the App is intended exclusively for personal, non-commercial purposes.
  2. You agree not to misuse the App, in particular not to perform manipulations, cheats or unauthorized modifications to the program code.
  3. Automated data extraction, reverse engineering or attempts to bypass security mechanisms are not permitted.

§ 5 Advertising

The free version of the App may contain advertisements via Google AdMob (banner and full-screen ads). Before serving personalized advertising, the App obtains your consent. You can change your settings at any time in the App. For more information, see our Privacy Policy.

§ 6 In-App Purchases

  1. The App optionally offers a one-time in-app purchase to remove banner advertising.
  2. The purchase is processed through the Apple App Store. Apple's terms of use also apply.
  3. Refunds are subject to Apple's policies. Requests must be directed to Apple.
  4. The purchase status is stored locally on the device. When changing devices, restoration via the App Store "Restore Purchases" feature may be required.

§ 7 Availability and Updates

We strive to provide a functional App. There is no entitlement to constant availability, error-free operation or specific game content. We may update the App at any time, adjust content or change features. Updates are provided through the App Store.

§ 8 Liability

  1. SkyDrop is intended for entertainment only. It does not constitute professional advice or training.
  2. We are fully liable for intent and gross negligence as well as for damages resulting from injury to life, body or health.
  3. In case of slightly negligent breach of essential contractual obligations, liability is limited to foreseeable, typical contractual damage.
  4. Otherwise, liability is excluded to the extent permitted by law.

§ 9 Changes to Terms

We reserve the right to change these Terms if objective reasons require it (e.g. changed legal requirements, new App features). We will inform you of significant changes in an appropriate manner, such as through the App, the App Store or this website. Continued use of the App after the changes take effect constitutes acceptance, unless you object.

§ 10 Final Provisions

  1. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
  2. Should individual provisions of these Terms be invalid, the validity of the remaining provisions shall remain unaffected.
  3. The place of jurisdiction is, where legally permissible, the location of the provider.
